Judge confirms Superman belongs to DC Comics



A federal judge confirmed Wednesday that the heirs of Superman co-creator Jerry Siegel relinquished any claims to the character in a 2001 agreement with DC Comics. However, that seems unlikely to end the nearly decade-long legal battle over the Man of Steel.

The order by U.S. District Judge Otis Wright III follows the January decision by the Ninth Circuit Court of Appeals that the Siegel heirs had accepted a 2001 offer from DC that permits the publisher to retain all rights to Superman (as well as Superboy and The Spectre) in exchange for $3 million in cash and contingent compensation worth tens of millions — and therefore were barred from reclaiming a portion of the writer's copyright to Action Comics #1.

Unwilling to give up, Siegel attorney Marc Toberoff introduced a new strategy earlier this month, arguing not only that the Ninth Circuit didn't settle all of the outstanding issues but that if there was a contract, then DC failed to perform: "DC anticipatorily breached by instead demanding unacceptable new and revised terms as a condition to its performance; accordingly, the Siegels rescinded the agreement, and DC abandoned the agreement."


According to The Hollywood Reporter, Wright left it to the Siegels to pursue a breach-of-contract lawsuit in state court, saying, "Because the court finds there was no rescission, acquiescence or abandonment as a matter of law, the contract remains in existence and enforceable."

However, despite an obvious eagerness to conclude "this chapter of the continuing Superman saga," the judge noted there remain "lingering issues" regarding Superboy and early promotional ads for Action Comics #1. Wright ordered that DC and the Siegel family file briefs by March 28 addressing how the Ninth Circuit's ruling affects their respective rights to those works.

He specified that the briefs be no longer than 15 pages and "include a brief proposal for swift resolution of the Superboy and Superman ad issues should the court find that the October 19 agreement does not extend to these works."

A federal judge determined in October that the 2003 copyright-termination notice filed by the estate of co-creator Joe Shuster was invalidated by a 20-year-old agreement with DC in which the late artist's sister Jean Peavy relinquished all claims to Superman in exchange "more than $600,000 and other benefits," including payment of Shuster's debts following his death earlier that year and a $25,000 annual pension for Peavy.

Superman compie 75 anni, si chiude la causa tra la Warner e gli eredi di Siegel

Superman ha compiuto 75 anni: il 18 aprile 1938 usciva infatti il primo numero di Action Comics. Per l'occasione, la Warner Bros. e la DC Comics hanno avuto una bella notizia: la corte distrettuale statunitense ha stabilito definitivamente che la compagnia possiede legittimamente i diritti di sfruttamento di Superboy e altri elementi del personaggio di Superman.

Il giudice Otis Wright III ha definito infatti che "l'accordo del 2001 tra la DC e gli eredi di Siegel assegnava nuovamente alla DC Superman, Superboy e una serie di pubblicità di Superman che furono utilizzate negli anni trenta, in cambio di anticipi sostanziosi e di royalty. Ciò conclude definitivamente una causa di proporzioni supereroistiche".

In marzo Wright aveva già stabilito che la Warner e la DC avevano ragione su una causa sollevata da Laura Siegel Larson e dagli eredi di Joanne Siegel: nel 2001 lo studio e gli eredi avevano raggiunto un accordo che successivamente gli eredi avevano messo in discussione (nel 2008 un giudice aveva stabilito che gli eredi Siegel controllavano ancora i diritti del personaggio, una decisione ora ribaltata). La compagnia è quindi definitivamente sola proprietaria dei diritti del supereroe e potrà finalmente utilizzarlo anche in altri film (successivi all'Uomo d'Acciaio).

Non solo. Negli anni la compagnia si era mossa con cautela proprio per evitare di interferire nella lunga vicenda legale, ma con la nuova decisione del giudice potrebbe decidere di spingersi anche a fare un film su Superboy, sempre che ne abbia l'interesse.

Nei fumetti la vedo uguale-uguale.

E' della Casa Editrice.
Sono un cittadino dello spazio. Mi ritengo quindi Apolide...e non italiano.

Appeals court denies Shuster heirs rehearing in Superman battle



In the latest — and, quite possibly, final — legal blow to the estate of Joe Shuster, the Ninth Circuit Court of Appeals has denied a petition for a rehearing of its November decision that effectively brought to an end what a three-judge panel described as "the long-running saga regarding the ownership of copyrights in Superman — a story almost as old as the Man of Steel himself."

Deadline reports that the one-page order closes the door to any more petitions for rehearing before the Ninth Circuit, leaving the Supreme Court as the only option left to attorney Marc Toberoff, who last year pledged, "My clients and I are prepared to go the distance."


In a 2-1 finding in November, the Ninth Circuit panel reaffirmed an October 2012 ruling that the Shuster estate is prevented from reclaiming the artist's stake in Superman by a 20-year-old agreement with DC Comics. That lower-court decision dealt with a 1992 agreement in which the Shuster estate relinquished all claims to the Man of Steel in exchange for "more than $600,000 and other benefits," which included paying Shuster's debts following his death earlier that year and providing his sister Jean Peavy and brother Frank Shuster with a $25,000 annual pension. U.S. District Judge Otis D. Wright had found the agreement invalidated a copyright-termination notice filed in 2003 by Shuster's nephew Mark Peary.

The October 2012 decision was the first of twin, seemingly fatal, blows in the battle by the creators' families for the Superman rights: Less than three months later, the Ninth Circuit overturned a 2008 decision that granted the heirs of Superman co-creator Jerry Siegel his 50-percent share of the copyright to the first Superman story in Action Comics #1, effectively giving DC full ownership of the character. That was followed in April by Wright's ruling that Superboy also belongs to the publisher.
